TERMS OF SERVICE – KONTRAST

The following terms of service define the cooperation rules with KONTRAST – Szymon Wojtusiak. They apply to service, luthier, maintenance and advisory services provided as part of business activity.

§1. Deadlines and contact

• Service completion time is determined individually.
• The client is obliged to collect the instrument within 14 days of being notified of work completion.
• After 30 days from work completion, storage fees may be charged.

§2. Scope of responsibility

• KONTRAST is not responsible for hidden defects of instruments that are revealed during or after service completion.
• The client accepts that service work may reveal structural or material problems not visible at the order acceptance stage.
• The company is not responsible for consequences resulting from previous interventions in the instrument that were not reported when placing the order.

§3. Client risk clause

The client acknowledges that some service or luthier work may involve the risk of revealing hidden material or structural defects of the instrument that were not possible to detect before starting work. KONTRAST reserves the right to interrupt work and inform the client about the need to determine further proceedings.

§4. Payments and advance payments

• For orders exceeding 600 PLN, the company may request an advance payment.
• The advance payment is non-refundable in case of client cancellation after work has started.
• Payment is made upon instrument collection, unless the parties agree otherwise.

§5. Personal data

• Client data is processed solely for the purpose of order fulfillment and is not shared with third parties.
• The client has the right to access, correct and request deletion of data in accordance with GDPR.

APPENDIX – CONTRACT CLAUSES (PROTECTIVE AND LEGAL)

1. Liability limitation clause:
   The contractor is not responsible for damages resulting from previous interventions, material defects or hidden equipment defects that were not possible to detect when accepting the order.
2. Risk acceptance confirmation clause:
   The client confirms that they have been informed about potential risks related to service/luthier work and accepts the possibility of revealing damage or complications resulting from construction or previous repairs.
3. Statutory interest clause:
   In case of payment delay, KONTRAST company has the right to charge statutory interest, in accordance with Art. 481 of the Civil Code.
4. Court jurisdiction clause:
   All disputes arising from the performance of this contract will be resolved by the court locally competent for the contractor's registered office.
